General Terms and Conditions for Warranties

These conditions set out the manner in which the warranty is granted for products sold by MODACO SRL, including display fridges, chest freezers, freezers, refrigerated multidecks, professional refrigeration equipment, accessories and spare parts.

These conditions apply together with the tax invoice, the warranty certificate, the user manual, the product page and any other documents provided to the customer at the time of sale.

The commercial warranty offered by MODACO SRL does not limit or remove the statutory rights of individual consumers, where applicable under current legislation.

1. The Warrantor

The warrantor of the products sold is:

For certain products, the warranty may be provided directly by the manufacturer, importer, distributor or an authorised service centre/partner, in accordance with the documents accompanying the product.

2. Types of Customers and Application of the Warranty

Depending on the status of the purchaser, the warranty conditions apply as follows:

2.1. Individual Consumers

A consumer is understood to be an individual who purchases the product for personal use, outside any commercial, industrial, craft or professional activity.

Consumers benefit from statutory rights regarding the guarantee of conformity, in accordance with applicable legislation. These rights are not affected by the commercial warranty offered by MODACO SRL.

2.2. Legal Entities, Sole Traders, Individual Enterprises and Other Professionals

For purchasers who acquire products for professional, commercial or economic activity purposes, the contractual/commercial warranty stated on the tax invoice, warranty certificate, commercial offer or product page applies.

Unless otherwise specified, new products benefit from a commercial warranty of 12 months from the date of purchase, covering manufacturing defects of internal components.

3. Warranty Duration

New products sold by MODACO SRL benefit, as a general rule, from a commercial warranty of 12 months from the date of purchase, unless another period is stated in the warranty certificate, tax invoice, commercial offer or product page.

For open-box, refurbished, second-hand or occasion products, the warranty period may differ and will be expressly stated on the tax invoice, warranty certificate, commercial offer or product page.

The warranty period begins from the date of delivery or, as the case may be, from the date of purchase stated on the tax invoice.

If the product is repaired under warranty, the warranty period is extended, where required by law, by the period during which the product could not be used due to the reported and confirmed defect.

In the event of product replacement, the warranty period for the replacement product applies in accordance with current legislation and/or the commercial conditions agreed between the parties.

4. What the Warranty Covers

The warranty covers manufacturing defects of the product and/or its internal components, arising under normal conditions of use, in accordance with the product's intended purpose, the instructions for use, the installation instructions and the operating conditions.

Depending on the nature of the product and the defect identified, the warranty may include, as applicable:

  • repair of the product;
  • replacement of the defective part;
  • dispatch of the defective part to the customer or to the service centre;
  • repair of the product at the MODACO SRL service centre;
  • intervention by a partner/approved service centre, if this is approved in advance;
  • replacement of the product, if repair is not possible or is not justified;
  • other measures established in accordance with the law or by agreement between the parties.

The warranty does not automatically entail full product replacement. Product replacement may only be carried out if the defect cannot be remedied by repair or by replacing the defective component, or if such a solution is required by law.

5. Warranty Claim Procedure

To submit a warranty claim, the customer must contact MODACO SRL through one of the following means:

  • by phone;
  • by email;
  • via the contact form on the website;
  • through other communication channels made available by MODACO SRL.

The request should include, as far as possible:

  • the customer's name or company name;
  • the tax invoice number;
  • the date of purchase;
  • the product model;
  • the product serial number, if available;
  • a description of the reported defect;
  • relevant photographs or video material;
  • photographs of the product's technical label;
  • photographs of the location where the product is installed, if the defect may be influenced by installation, ventilation or operating conditions.

MODACO SRL may request additional information for product identification and verification of the reported defect.

The customer is obliged not to interfere with the product before inspection and not to allow intervention by unauthorised persons without the prior consent of MODACO SRL.

6. Defect Inspection

The reported defect must be verified by qualified technical personnel, an authorised service centre, a refrigeration technician or a representative/partner approved by MODACO SRL, depending on the nature of the product and the specific circumstances.

In the case of refrigeration equipment, the inspection may involve checking the following elements:

  • electrical supply;
  • the thermostat or digital controller;
  • temperature sensors;
  • the compressor;
  • fans;
  • the condenser;
  • the evaporator;
  • the refrigeration circuit;
  • the refrigerant;
  • door gaskets;
  • the defrost system;
  • placement and ventilation conditions;
  • product loading method;
  • ambient temperature;
  • any signs of impact, incorrect transport or improper handling.

If the inspection confirms the existence of a manufacturing defect or a non-conformity covered by the warranty, MODACO SRL will indicate the appropriate remediation solution.

If the inspection reveals that the defect was caused by improper use, mishandling, unauthorised intervention, inadequate electrical supply, lack of maintenance or other causes unrelated to a manufacturing defect, the intervention may be treated as an out-of-warranty intervention.

7. Remediation Method

Depending on the product, the defect and the specific circumstances, MODACO SRL may decide on one of the following remediation methods:

7.1. Dispatch of the Defective Part

For certain products, the warranty may consist of dispatching the defective part — such as a motor, compressor, fan, thermostat, controller, sensor or other internal component — after the defect has been identified by a qualified technician and the claim has been validated by MODACO SRL.

The part will be dispatched to the customer, to the technician indicated by the customer or to the approved service centre, depending on the situation.

Installation of the part must be carried out by qualified personnel. MODACO SRL is not liable for incorrect installation of parts performed by unauthorised or unqualified persons.

7.2. Repair of the Product at a Service Centre

For products requiring complex checks, MODACO SRL may request that the product be brought to its own service centre or to a partner/approved service centre.

The product must be handed over clean, emptied of goods and appropriately packaged for transport, so as to avoid additional damage.

7.3. On-site Intervention at the Customer's Location

On-site interventions at the customer's location are only carried out if approved in advance by MODACO SRL and if the nature of the product permits this.

The customer is obliged to provide access to the equipment, empty the unit of goods, allow inspection of the electrical installation and ensure normal working conditions for the technician.

For corporate customers/professionals, travel, inspection, labour and transport costs apply in accordance with the commercial warranty, offer or agreement between the parties.

For individual consumers, costs associated with the remediation of a confirmed non-conformity apply in accordance with current legislation.

8. Resolution Timeframes

MODACO SRL will make every effort to resolve warranty claims within a reasonable timeframe, depending on the nature of the product, the complexity of the defect, the availability of parts and the method of intervention.

For individual consumers, repair or replacement is carried out in accordance with the timeframes provided by applicable legislation.

For corporate customers/professionals, the estimated timeframe for diagnosis and repair is, as a general rule, up to 10 working days from the date the product is received at the service centre or from the date all information necessary for the inspection is received, except in situations where special parts, external orders, complex interventions or additional checks are required.

The timeframe may be extended in justified situations, with the customer being informed accordingly.

9. Transport of the Product

If the product needs to be sent to a service centre, it must be packaged and transported appropriately so as not to sustain additional damage.

The customer is obliged to follow the product-specific handling and transport instructions. Refrigeration equipment must not be transported, tipped over, subjected to impact or handled in any way that may affect the refrigeration circuit, the compressor, the glass panels, the doors or the internal components.

For corporate customers/professionals, unless otherwise agreed, transport of the product to and from the service centre is at the customer's expense.

For individual consumers, transport costs related to the remediation of a confirmed non-conformity are borne in accordance with current legislation.

If the product is sent to a service centre, the customer must empty it of all products, food, beverages, packaging or other items stored inside.

10. Documents Required for a Warranty Claim

The following documents are required for the warranty to be granted:

  • the completed warranty certificate, if one was issued;
  • the purchase tax invoice;
  • proof of payment, if requested;
  • photographs or video material showing the reported defect;
  • photographs of the product serial number and technical label;
  • an inspection report, technical report or estimate, if these were requested;
  • any other documents required for verification of the claim.

The absence of documents may delay the resolution of the warranty claim.

11. Situations Not Covered by the Warranty

The warranty is granted exclusively for manufacturing defects of the product and/or its internal components, arising under normal conditions of use, in accordance with the product's intended purpose and operating instructions.

Without affecting the statutory rights of consumers, the warranty does not cover defects, damage or improper functioning of the product in the following situations:

11.1. Inadequate Electrical Supply

Not covered are defects caused by voltage fluctuations, overvoltage, undervoltage, electrical surges, sockets without earthing, defective, improvised or non-compliant electrical installations, the use of inappropriate extension leads, adapters or multi-socket adapters, as well as the absence of adequate electrical protection.

The customer is obliged to connect the product to a safe, inspected electrical installation appropriate for the equipment's power requirements.

11.2. Incorrect Transport, Handling or Storage

Not covered is damage arising from incorrect transport, handling, moving, lifting, unloading or storage of the equipment after delivery.

This includes impacts, cracks, scratches, bending, deformation, broken glass, damaged panels, misaligned doors or other physical damage that was not identified and noted at the time of receipt of the product.

Visible transport damage must be reported at the time of receipt of the product and noted on the transport documents, where possible.

11.3. Improper Installation or Placement

Not covered are defects caused by placing the product on uneven, unstable or unsuitable surfaces, in spaces without adequate ventilation, near heat sources, in direct sunlight, near ovens, radiators, heat-generating equipment or in areas where the ambient temperature exceeds the recommended operating limit for the product.

Refrigeration equipment must be installed in ventilated spaces, away from extreme temperatures and direct heat sources.

11.4. Blocked Ventilation or Insufficient Clearance for Airflow

Not covered are defects caused by blocking the ventilation grilles, condenser, fans or hot air exhaust areas.

The equipment must be installed so as to allow free circulation of air around the technical components.

11.5. Lack of Regular Cleaning and Maintenance

Not covered are defects caused by failure to regularly clean the condenser, or by accumulation of dust, lint, grease, dirt, food residues or other contaminants that may affect cooling performance, the compressor, the fans or the overall efficiency of the equipment.

The user is obliged to maintain the product regularly, in accordance with the instructions for use.

11.6. Overloading the Product or Blocking Cold Air Circulation

Not covered are temperature or operational issues caused by excessive product loading, covering airflow zones, placing products above the recommended limit, blocking the evaporator or insufficient space for cold air circulation inside the display fridge.

Products must be arranged so as to allow air circulation and correct operation of the equipment.

11.7. Use of the Product for a Purpose Other Than That for Which It Was Designed

Not covered are defects arising from using the product for product categories other than those recommended.

Display fridges must be used in accordance with their intended purpose: meat, cold cuts, dairy, beverages, pastry, confectionery, flowers, freezing or other categories specified for the respective model.

Using the equipment for hot products, unsuitable products, chemical substances, corrosive materials or other incompatible products may result in the warranty being refused for any resulting defects.

11.8. Loading Warm Products into the Equipment

Not covered are defects or temperature issues caused by placing warm products, or large quantities of products that have not been pre-chilled, into a display fridge, chest freezer or freezer.

Refrigeration equipment is designed to maintain the temperature of products, not to rapidly chill large quantities of warm goods, unless the product is expressly provided with such a function.

11.9. Incorrect Cleaning or Use of Unsuitable Substances

Not covered is damage caused by cleaning with a water jet, pressurised steam, abrasive, acidic, corrosive or flammable substances, or unsuitable detergents.

Also not covered are scratches, dulling, flaking, oxidation or surface damage caused by inappropriate cleaning methods.

11.10. Unauthorised Interventions on the Product

Any intervention, modification, disassembly, repair or component replacement carried out by unauthorised persons or without the prior consent of MODACO SRL may result in the warranty being refused for the reported defect.

This includes interventions on the refrigeration circuit, the compressor, the thermostat, the controller, the electrical installation, wiring, fans, the refrigerant or any internal components.

11.11. Modification of the Refrigeration Circuit or Refrigerant

Not covered are defects caused by unauthorised loss, top-up, replacement or modification of the refrigerant.

In the case of equipment using flammable refrigerant, such as R290, interventions must be carried out exclusively by qualified personnel, in compliance with applicable safety regulations.

11.12. Defects Caused by External Factors

Not covered are defects caused by fire, flooding, excessive humidity, condensation from the working environment, frost, extreme temperatures, storms, electrical discharges, natural disasters, pests, rodents, insects or other external causes unrelated to a manufacturing defect of the product.

11.13. Normal Wear and Consumable Components

The warranty does not cover normal wear and tear of the product and components subject to wear under normal operating conditions, such as door gaskets, handles, hinges, castors, adjustable feet, aesthetic elements, bulbs/LEDs, detachable accessories, trays, shelves, glass panels, exterior panels or other elements that may deteriorate over time through normal use.

Exceptions apply where a manufacturing defect in these components is identified.

11.14. Non-compliance with the Instructions for Use

The warranty may be refused for the reported defect if it is established that the defect was caused by failure to follow the installation, use, cleaning, maintenance, loading, ambient temperature or operating instructions provided to the customer through the user manual, warranty certificate, sales invoice, product page or other documents made available.

11.15. Use of the Product in Unsuitable Environmental Conditions

Not covered are defects caused by using the equipment in spaces with excessive humidity, excessive dust, grease vapours, corrosive environments, very high or very low temperatures, unprotected outdoor spaces or other environmental conditions incompatible with the product's intended purpose.

11.16. Issues Caused by Condensation

Condensation may occur under certain conditions of humidity, high ambient temperature, frequent door opening, improper placement or insufficient ventilation.

Condensation caused by environmental conditions, usage or placement does not, in itself, constitute a manufacturing defect and is not covered by the warranty.

11.17. Glass Panels, Exterior Panels and Aesthetic Elements

Glass panels, exterior panels, casing elements, trims, decorative elements and other aesthetic components are not covered by the warranty for impacts, scratches, cracks, fractures, breakage or other damage occurring after delivery.

These elements may only be covered if a manufacturing defect existing at the time of delivery is identified and reported in accordance with the receipt procedure.

12. Products Stored in Refrigeration Equipment

MODACO SRL assumes no responsibility for the preservation, integrity, loss or spoilage of products stored in refrigeration equipment in the event of a malfunction, accidental shutdown, technical intervention, transport to a service centre or handover of the equipment for repair.

The customer is obliged to regularly check the product temperature and to move perishable goods to an alternative refrigerated space as soon as improper operation is observed.

Before handing the product over to a service centre or prior to a technical intervention, the equipment must be completely emptied of all products, food, beverages or other items stored inside.

The warranty does not cover commercial losses, loss of profit, the cost of spoiled products, interruption of the beneficiary's business or other indirect damages resulting from the shutdown or improper operation of the equipment, except where the law provides otherwise.

13. Equipment with Static Cooling

In the case of display fridges equipped with a static cooling system, the flow of cold air is achieved through natural convection.

Accordingly, the existence of temperature variations of approximately 2–4°C between different zones of the interior — for example, between upper and lower shelves — is a normal operating characteristic of this type of technology.

Maintaining as uniform a temperature as possible is directly influenced by the loading pattern of the display fridge, the quantity of products, the temperature of the products placed inside, the frequency of door/glass opening, the ambient temperature and cold air circulation.

Obstruction of airflow paths through excessive product loading may increase temperature differences.

The user is responsible for arranging products so as to allow free cold air circulation and correct operation of the equipment.

14. Receipt of the Product upon Delivery

Upon receipt of the product, the customer is obliged to inspect the condition of the packaging and the product.

Any visible damage, impact, broken glass, torn packaging, deformation or missing components must be reported at the time of delivery and recorded on the transport documents or in an inspection report, where possible.

Claims regarding visible physical damage occurring during transport may be rejected if the product was received without objection and without any visible damage being noted at the time of delivery.

This provision does not affect the statutory rights of consumers in the case of non-conformities that could not reasonably have been observed at the time of receipt.

15. Out-of-Warranty Interventions

If the inspection determines that the reported defect is not covered by the warranty, MODACO SRL may offer the customer a chargeable repair solution.

In this case, the customer will be informed of the estimated costs for inspection, transport, travel, labour and parts, as applicable.

Out-of-warranty repair is carried out only upon the customer's acceptance, unless the parties have agreed otherwise.

16. Spare Parts

Parts replaced under warranty become the property of MODACO SRL or the manufacturer/importer, as applicable, if their return is requested.

MODACO SRL may request the return of the defective part for inspection, technical analysis or reimbursement with the manufacturer/importer.

If the customer does not return the defective part when this has been requested, MODACO SRL reserves the right to refuse reimbursement for the part or to claim its value, to the extent permitted by law and by the applicable commercial conditions.

17. Customer Obligations

To maintain the validity of the warranty, the customer has the following obligations:

  • to use the product in accordance with its intended purpose;
  • to read and follow the instructions for use;
  • to install the product in a suitable space;
  • to ensure an adequate electrical supply;
  • to clean and maintain the product regularly;
  • not to block ventilation or air circulation;
  • not to overload the product;
  • not to place warm products inside, if the equipment is not designed for this purpose;
  • not to allow unauthorised interventions;
  • to notify MODACO SRL as soon as improper operation is observed;
  • to move perishable goods to an alternative space if the equipment is no longer functioning correctly;
  • to provide the documents and information required for warranty resolution.

18. Additional Notes

A demonstration of proper functioning, explanations regarding product use and the main operating instructions may be provided to the purchaser before or at the time of delivery/handover of the product.

The customer confirms that they have received or had the opportunity to consult the information regarding the use, maintenance and warranty conditions of the product.

Failure to follow the instructions for use, installation, cleaning and maintenance may result in the warranty being refused for the reported defect, if there is a link between non-compliance with these instructions and the defect that has arisen.

These conditions may be supplemented by specific provisions for certain products, product categories or commercial offers.

If any provision of these conditions becomes inapplicable under the law, the remaining provisions shall remain valid.
